Accommodation Terms and Conditions

Article 1 (Scope of Application)

  1. 1.Accommodation contracts and related agreements to be concluded between this Hotel (hereinafter referred to as "the Hotel") and the Guest shall be governed by these Terms and Conditions. Any particulars not provided for herein shall be governed by laws and regulations (meaning laws and regulations or those based on them; the same shall apply hereinafter) or generally established customs.
  2. 2.In the case where the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws, regulations, and customs, the minor special contract shall take precedence over the provisions of the preceding paragraph, notwithstanding the provisions of the preceding paragraph.

Article 2 (Application for Accommodation Contracts)

  1. 1.A person who intends to make an application for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:
  1. (1)Name of the Guest(s);
  2. (2)Date of accommodation and estimated time of arrival;
  3. (3)Accommodation Charges (based, in principle, on the Basic Accommodation Charges listed in Appended Table 1); and
  4. (4)Other particulars deemed necessary by the Hotel.
  1. 2.In the case where the Guest requests, during their stay, an extension of the accommodation beyond the date in item (2) of the preceding paragraph, the Hotel shall process such request as an application for a new Accommodation Contract at the time such request is made.

Article 3 (Conclusion of Accommodation Contracts, etc.)

  1. 1.An Accommodation Contract shall be deemed to have been concluded when the Hotel has accepted the application as described in the preceding Article. However, this shall not apply when it has been proved that the Hotel has not accepted the application.
  2. 2.When an Accommodation Contract has been concluded in accordance with the provisions of the preceding paragraph, the Guest shall pay an accommodation deposit fixed by the Hotel, up to the limit of the Basic Accommodation Charges for the period of stay (or for 3 days if the period of stay exceeds 3 days), by the date specified by the Hotel.
  3. 3.The deposit shall be first allocated to the final Accommodation Charges to be paid by the Guest, then secondly to the cancellation charges and thirdly to the compensation for damages if a situation arises to which the provisions of Article 6 or Article 18 are applicable, and the remainder, if any, shall be refunded at the time of the payment of the Accommodation Charges as stated in Article 12.
  4. 4.When the Guest fails to pay the deposit by the date specified by the Hotel as stipulated in paragraph 2, the Accommodation Contract shall lose its validity. However, this shall apply only in the case where the Hotel has notified the Guest to that effect when specifying the due date for the payment of the deposit.

Article 4 (Special Contracts Requiring No Accommodation Deposit)

  1. 1.Notwithstanding the provisions of paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded.
  2. 2.In the case where the Hotel has not requested the payment of the deposit as stipulated in paragraph 2 of the preceding Article and/or has not specified the date of payment of the deposit at the time of accepting the application for the Accommodation Contract, the Hotel shall be treated as having accepted a special contract prescribed in the preceding paragraph.

Article 4-2 (Request for Cooperation in Infection Prevention Measures at the Facility)

  1. 1.The Hotel may request cooperation from a person who intends to stay in accordance with the provisions of Article 4-2, paragraph 1 of the Hotel Business Act (Act No. 138 of 1948).

Article 5 (Refusal of Accommodation Contracts)

  1. 1.The Hotel may not accept the conclusion of an Accommodation Contract under any of the following cases. However, this paragraph does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act:
  1. (1)When the application for accommodation does not conform with the provisions of these Terms and Conditions;
  2. (2)When the Hotel is fully booked and no room is available;
  3. (3)When the person seeking accommodation is deemed liable to conduct himself/herself, in a manner that will contravene the laws or act against the public order or good morals in regard to his/her accommodation;
  4. (4)When the person seeking accommodation is recognized to fall under any of the following categories (a) to (c):
  1. (a)An organized crime group (hereinafter referred to as "Violence Group") under Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), a member of a Violence Group (hereinafter referred to as "Violence Group Member") under Article 2, Item 6 of the said Act, an associate member of a Violence Group, a person related to a Violence Group, or any other antisocial forces;
  2. (b)A corporation or other organization whose business activities are controlled by a Violence Group or a Violence Group Member;
  3. (c)A corporation of which any of its officers falls under the category of a Violence Group Member;
  1. (5)When the person seeking accommodation has behaved in a manner that causes significant annoyance to other guests;
  2. (6)When the person seeking accommodation is a patient, etc. with a specified infectious disease (hereinafter referred to as "Patient, etc. with Specified Infectious Disease") as prescribed in Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act;
  3. (7)When a violent demanding act is committed or a burden exceeding a reasonable range is requested in regard to the accommodation (except when the person seeking accommodation requests the removal of social barriers pursuant to the provisions of Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act for Eliminating Discrimination against Persons with Disabilities (Act No. 65 of 2013; hereinafter referred to as the "Act for Eliminating Discrimination against Persons with Disabilities"));
  4. (8)When the person seeking accommodation has repeatedly made requests to the Hotel that place an excessive burden on its implementation and may significantly impede the provision of accommodation-related services to other guests, as prescribed by Article 5-6 of the Ordinance for Enforcement of the Hotel Business Act;
  5. (9)When the Hotel is unable to provide accommodation due to natural disasters, malfunction of the facilities or other unavoidable causes; or
  6. (10)When the case falls under the provisions of Article 5 of the Miyagi Prefectural Hotel Business Act Enforcement Ordinance.

Article 5-2 (Explanation for Refusal to Conclude Accommodation Contract)

  1. 1.The person seeking accommodation may request the Hotel to provide an explanation of the reasons if the Hotel does not accept the conclusion of an Accommodation Contract based on the preceding Article.

Article 6 (Guest's Right to Cancel Accommodation Contract)

  1. 1.The Guest is entitled to cancel the Accommodation Contract by so notifying the Hotel.
  2. 2.In the case where the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable (except in the case where the Hotel has requested the payment of the deposit during the specified period as prescribed in Article 3, Paragraph 2 and the Guest has cancelled the Contract before the payment), the Hotel shall charge cancellation fees as listed in Appended Table 2. However, in the case where a special contract as prescribed in Article 4, Paragraph 1 has been concluded, the same shall apply only when the Hotel has notified the Guest of his/her obligation of payment of the cancellation fees for breach of contract upon accepting the special contract.
  3. 3.In the case where the Guest does not appear by 6:00 p.m. on the accommodation date (or 2 hours after the estimated time of arrival if explicitly specified) without notifying the Hotel, the Hotel may regard the Accommodation Contract as being cancelled by the Guest and process it accordingly.

Article 7 (Hotel's Right to Cancel Accommodation Contract)

  1. 1.The Hotel may cancel the Accommodation Contract under any of the following cases. However, this paragraph does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act:
  1. (1)When the Guest is deemed liable to conduct himself/herself, or has conducted himself/herself in a manner that will contravene the laws or act against the public order or good morals in regard to his/her accommodation;
  2. (2)When the Guest is recognized to fall under any of the following categories (a) to (c):
  1. (a)A Violence Group, a Violence Group Member, an associate member of a Violence Group, or a person related to a Violence Group, or any other antisocial forces;
  2. (b)A corporation or other organization whose business activities are controlled by a Violence Group or a Violence Group Member;
  3. (c)A corporation of which any of its officers falls under the category of a Violence Group Member;
  1. (3)When the Guest has behaved in a manner that causes significant annoyance to other guests;
  2. (4)When the Guest is a Patient, etc. with a Specified Infectious Disease;
  3. (5)When a violent demanding act is committed or a burden exceeding a reasonable range is requested in regard to the accommodation (except when the Guest requests the removal of social barriers pursuant to the provisions of Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act for Eliminating Discrimination against Persons with Disabilities);
  4. (6)When the Guest has repeatedly made requests to the Hotel that place an excessive burden on its implementation and may significantly impede the provision of accommodation-related services to other guests, as prescribed by Article 5-6 of the Ordinance for Enforcement of the Hotel Business Act;
  5. (7)When the Hotel is unable to provide accommodation due to natural disasters or other force majeure causes;
  6. (8)When the case falls under the provisions of Article 5 of the Miyagi Prefectural Hotel Business Act Enforcement Ordinance;
  7. (9)When the Guest does not manifest compliance with the rules prohibited by the Hotel, such as smoking in bed, tampering with firefighting equipment, or other prohibitions specified in the House Regulations (limited to those necessary for fire prevention).
  1. 2.In the case where the Hotel has cancelled the Accommodation Contract in accordance with the provisions of the preceding paragraph, the Hotel shall not charge the Guest for any accommodation services, etc. which have not yet been offered.

Article 7-2 (Explanation for Cancellation of Accommodation Contract)

  1. 1.The Guest may request the Hotel to provide an explanation of the reasons if the Hotel cancels the Accommodation Contract based on the preceding Article.

Article 8 (Registration of Accommodation)

  1. 1.The Guest shall register the following particulars at the front desk of the Hotel on the day of accommodation:
  1. (1)Name, address, and contact information of the Guest(s);
  2. (2)For non-Japanese guests who do not have a domicile in Japan, their nationality and passport number; and
  3. (3)Other particulars deemed necessary by the Hotel.
  1. 2.In the case where the Guest intends to pay the charges mentioned in Article 12 by alternative means such as traveler's checks, accommodation coupons, or credit cards, which can be substituted for currency, such alternative means shall be presented in advance at the time of registration prescribed in the preceding paragraph.

Article 9 (Occupancy Hours of Guest Rooms)

  1. 1.The Guest is entitled to occupy the contracted guest room of the Hotel from 3:00 p.m. to 10:00 a.m. of the following morning. However, in the case where the Guest stays consecutively, the Guest may occupy it all day long, except for the days of arrival and departure.
  1. 2.The Hotel may, notwithstanding the provisions of the preceding paragraph, permit the Guest to occupy the room beyond the time prescribed in the same paragraph. In this case, extra charges shall be applied as follows:
  1. (1)Up to 3 hours of excess: 30% of the amount equivalent to the room charge;
  2. (2)Up to 6 hours of excess: 60% of the amount equivalent to the room charge; and
  3. (3)More than 6 hours of excess: 100% of the amount equivalent to the room charge.
  1. 3.The amount equivalent to the room charge mentioned in the preceding paragraph shall be 70% of the Basic Accommodation Charges.

Article 10 (Compliance with House Regulations)

  1. 1.The Guest shall observe the House Regulations established by the Hotel within the premises of the Hotel.

Article 11 (Business Hours)

  1. 1.The business hours of the principal facilities, etc. of the Hotel are as follows, and those of other facilities shall be notified in detail by pamphlets provided, notices displayed at various places, or the service directory in guest rooms, etc.:
  1. (1)Service hours of the Front Desk, etc.:
    1. (a)Curfew:12:00 a.m. (Midnight)
    2. (b)Front Desk Service:11:00 p.m.
  2. (2)Service hours for Dining (Facilities):
    1. (a)Breakfast:7:00 a.m. – 9:00 a.m.
    2. (b)Lunch:11:30 a.m. – 2:00 p.m.
    3. (c)Dinner:5:30 p.m. – 9:00 p.m.
  3. (3)Ancillary Facilities Service Hours:3:00 p.m. – 11:00 p.m.
  1. 2.The hours mentioned in the preceding paragraph may be temporarily changed for unavoidable reasons. In such a case, the Guest shall be informed by appropriate means.

Article 12 (Payment of Charges)

  1. 1.The breakdown of the Accommodation Charges, etc. to be paid by the Guest shall be as listed in Appended Table 1.
  2. 2.Payment of the Accommodation Charges, etc. as specified in the preceding paragraph shall be made in currency or by alternative means approved by the Hotel, such as traveler's checks, accommodation coupons, or credit cards, at the front desk at the time of departure of the Guest or when requested by the Hotel.
  3. 3.Accommodation Charges shall be charged even if the Guest voluntarily chooses not to stay in the guest room after the guest room has been provided and made available for use by the Hotel.

Article 13 (Liabilities of the Hotel)

  1. 1.The Hotel shall compensate the Guest for damage if the Hotel has caused damage to the Guest in the course of fulfillment or non-fulfillment of the Accommodation Contract and/or related agreements. However, this shall not apply when such damage has been caused due to reasons for which the Hotel is not liable.
  2. 2.The Hotel is covered by Hotel Liability Insurance to deal with unexpected fires and/or other disasters.

Article 14 (Handling When Unable to Provide Contracted Rooms)

  1. 1.The Hotel shall, when unable to provide the contracted room(s), arrange other accommodation of quite the same conditions for the Guest as far as possible, with the consent of the Guest.
  2. 2.When the Hotel cannot arrange other accommodation notwithstanding the provisions of the preceding paragraph, the Hotel shall pay a compensation fee equivalent to the cancellation charges to the Guest, and the compensation fee shall be applied to the reparative damages. However, when the inability to provide the room is not due to causes for which the Hotel is liable, the Hotel shall not pay the compensation fee.

Article 15 (Handling of Deposited Articles)

  1. 1.The Hotel shall compensate the Guest for damages when loss, breakage, or other damage occurs to goods, cash, or valuables deposited by the Guest at the front desk, except in the case of force majeure. However, for cash and valuables, when the Hotel has requested a declaration of the type and value thereof and the Guest failed to do so, the Hotel shall compensate for the damage up to a limit of 100,000 yen.
  2. 2.The Hotel shall compensate the Guest for damages when loss, breakage, or other damage occurs through intent or negligence on the part of the Hotel to goods, cash, or valuables brought into the premises of the Hotel by the Guest but not deposited at the front desk. However, for articles of which the type and value have not been declared in advance by the Guest, the Hotel shall compensate for the damage up to a limit of 300,000 yen, except in cases where the damage was caused by intent or gross negligence on the part of the Hotel.

Article 16 (Custody of Baggage or Belongings of the Guest)

  1. 1.When the baggage of the Guest is bound to arrive at the Hotel prior to his/her stay, the Hotel shall store it with responsibility only when such arrival has been approved by the Hotel before its arrival, and shall hand it over to the Guest at the front desk at the time of his/her check-in.
  2. 2.When the baggage or belongings of the Guest are found left behind at the Hotel after his/her check-out, and the ownership of such article is confirmed, the Hotel shall inform the owner of the article and ask for further instructions. However, when no instruction is given by the owner or when the ownership is not confirmed, the Hotel shall keep the article for 7 days including the day it was found, and after this period, the Hotel shall deliver it to the nearest police station.
  3. 3.The Hotel's liability for the custody of the Guest's baggage or belongings in the case of the preceding two paragraphs shall be governed by the provisions of paragraph 1 of the preceding Article in the case of paragraph 1, and by the provisions of paragraph 2 of the preceding Article in the case of paragraph 2.

Article 17 (Liability for Parking)

  1. 1.The Hotel shall not be liable for the custody of the vehicle of the Guest when the Guest utilizes the parking lot of the Hotel, as the Hotel merely offers the space for parking, whether the key of the vehicle has been deposited to the Hotel or not. However, the Hotel shall compensate for the damage caused through intent or negligence on the part of the Hotel in regard to the management of the parking lot.

Article 18 (Liability of the Guest)

  1. 1.The Guest shall compensate the Hotel for damage caused through intent or negligence on the part of the Guest.

Remarks

  1. 1.The Basic Accommodation Charge is based on the tariff displayed at the time of concluding the contract.
  2. 2.Child rates apply to children elementary school age and under. 70% of the adult rate is charged when meals and bedding equivalent to adults are provided; 50% when child-specific meals and bedding are provided; and 3,300 yen when only bedding is provided.
  3. 3.For infants for whom no bedding or meals are provided, 2,200 yen will be charged.

Note

  1. 1.The percentages represents the ratio of the cancellation charge to the Basic Accommodation Charge.
  2. 2.When the number of contracted days is shortened, a cancellation charge for one day (the first day) shall be collected regardless of the number of days shortened.
  3. 3.In the case where part of the group contract is cancelled, the cancellation charge shall be collected based on the above criteria for the number of guests cancelled.
  4. 4.If a separate cancellation policy is specified for specific accommodation plans, that policy shall take precedence.
